PRIVACY POLICY

The company ACE DENIM (hereinafter referred to as "ACE DENIM", the "Data Controller", "we", "our") sells in its physical stores and on its website www.acedenim.com (the "Site") of ready-to-wear articles and accessories under the "ACE DENIM" brand.
In order to offer a complete online user experience to its customers and support the sale of its products, ACE DENIM collects personal data (the "Data" or "Personal Data") from its customers using its Site or making purchases in-store (the "Customer(s)").
Personal Data refers to any information that can directly or indirectly identify Customers, such as their first name, last name, postal address, email, or Customer number.
This privacy policy (the "Privacy Policy") aims to inform Customers of the measures implemented by ACE DENIM to ensure the compliance of its collection, consultation, retention, and processing of Personal Data carried out in accordance with the provisions of the General Data Protection Regulation No. 2016/679 of April 27, 2016 (the "GDPR") and the French law No. 78/17 of January 6, 1978, in its current version (the "Data Protection Act").
The Personal Data collected are subject to processing, meaning any operation or set of operations performed on Personal Data, regardless of the method used (collection, recording, organization, storage, adaptation, modification, extraction, consultation, use, communication, combination, limitation, or destruction) (hereinafter the "Processing").
Article 1. DATA CONTROLLER
The data controller who collects and manages the Personal Data of Customers on the Site and in stores is the company ACE DENIM, a simplified joint-stock company (S.A.S) with a capital of 10,000 euros, registered with the Paris Trade and Companies Register (RCS) under number 844 857 789, whose registered office is located at 91 rue du Faubourg Saint-Honoré 75008 Paris.

Article 2. DATA COLLECTION
We collect certain categories of Personal Data from our Customers during their in-store experience or when they browse the Site and place an order (hereinafter the "Order(s)").
- Client Identification Data: information that every Client provides when making a purchase on the Site, either mandatory or optional (last name, first name, password to log into the account, email address, shipping and billing postal addresses, phone number);
- Data related to browsing on the Site: information collected by ACE DENIM during the Client's browsing on the Site (date and time of connection and/or browsing, pages visited, type of device and browser, geolocation, browser language, internet service provider, IP address);
- Order Data: information collected by ACE DENIM allowing the processing of Orders placed by the Client on the Site (purchase history in store and on the Site, first name, last name, email address, phone number, delivery and billing postal addresses, and chosen payment method);
- Order Payment Data: information collected directly by ACE DENIM's payment providers, including PayPal, under their own terms and privacy policies (first name, last name, email address, phone number, shipping and billing postal addresses, credit card number, expiration date, authorization number, and security code);
- Customer Service Data: data collected by ACE DENIM's Customer Service (the "Customer Service") during interactions with the Customer regarding their Orders and/or the use of the Site (first name, last name, email address, phone number, delivery and billing postal addresses).
The Client agrees to provide updated and valid Personal Identification Data, as part of the information required on the Site, and agrees not to provide any incorrect information.
Article 3. PURPOSES AND LEGAL BASES FOR DATA COLLECTION
ACE DENIM uses Customers' Personal Data for the purposes set out below and based on the following legal grounds:

Article 4. LEGAL BASES FOR THE COLLECTION AND PROCESSING OF PERSONAL DATA
The different Personal Data Processing operations are based on the following legal grounds:
- Execution of the contract concluded between ACE DENIM and its Clients;
- Legitimate interest of ACE DENIM;
- Execution of a legal obligation incumbent on ACE DENIM;
- Specific, free, and informed consent of the Client (notably for receiving newsletters).
Article 5. DURATION OF PERSONAL DATA RETENTION
ACE DENIM retains the Personal Data of its Clients for a limited duration proportional to the purpose of the Processing for which it was collected.
The data necessary for the creation and management of the Client account and for marketing and commercial communications are kept for 3 (three) years after the last contact by the Client on the Site or in-store or after the withdrawal of their consent to receive communications.
The data necessary for Customer Service, purchasing, and order management are retained for the duration of the contractual relationship and the applicable legal warranties.
The data collected by the analytical and functional cookies of the Site are kept for a period of 13 (thirteen) months.
Article 6. RECIPIENTS OF PERSONAL DATA
The Personal Data of Customers that have been collected are intended to be processed by the authorized staff of ACE DENIM.
ACE DENIM may also transfer this Data to external service providers who perform Data Processing, including its payment service providers:
Ø STRIPE (France) EURL, single-member limited liability company, registered with the Paris Trade and Companies Register under number 807 572 011, whose registered office is located at 10, Boulevard Haussmann – 75009 Paris. For any information, the Client can consult the following website: https://stripe.com/en-fr.
Ø PAYPAL (Europe) S.à.r.l. et Cie, Luxembourg limited partnership with share capital, registered with the Luxembourg R.C.S under number B118349, whose registered office is located at 22-24, Boulevard Royal – L-2449 Luxembourg. For any information, the Client can consult the following website: https://www.paypal.com.The payment for the Order is made on PAYPAL's own interface and ACE DENIM does not have access to the Data requested during the payment. The Customer can, at any time, modify or delete their Data collected by PAYPAL.
Ø GOOGLE FRANCE (GOOGLE PAY), limited liability company, registered with the Paris Trade and Companies Register under number 443 061 841, whose registered office is located at 8 rue de Londres – 75009 Paris. For any information, the Client can consult the following website: https://pay.google.com/intl/fr_fr/about/. The payment of the Order is made on the GOOGLE PAY interface itself and ACE DENIM does not have access to the Data requested during the payment. The Customer can, at any time, modify or delete their Data collected by GOOGLE.
Other recipients of Data:
Ø Customs services and providers in case of delivery abroad;
Ø Tax refund service providers;
Ø ACE DENIM stores and outlets.
ACE DENIM may also transfer the Data to subcontractors who carry out Processing on behalf of ACE DENIM:
Ø Order preparation, shipping, and return services (Chronopost, Colissimo)
Ø The updating and improvement of the Site's content (Google, Meta, …)
ARTICLE 7. USE OF SOCIAL MEDIA PLUGINS
ACE DENIM maintains social media accounts such as Instagram that Customers can access via the corresponding buttons on the Site.
During the visit of Customers to the ACE DENIM Site and on its social media pages, Customers' Personal Data may be transferred to a server in a third country and therefore processed outside the European Union.
Article 8. TRANSFER OF PERSONAL DATA OUTSIDE THE EUROPEAN UNION
ACE DENIM may transfer this Data to its service providers involved in the services delivered to Clients (including carriers, hosts, and technical service providers to manage the Websites). These providers may be located outside the European Union, notably in the United States.
All Data transfers are carried out under the standard contractual clauses of the European Commission and within the framework of adequacy decisions established between the countries of the European Union and the country concerned by the transfer.
We require the recipients of the Data to comply with the conditions set forth in this Privacy Policy and to implement the necessary measures to ensure the same level of protection as required by European regulations.
Article 9. COOKIES, TAGS and TRACKERS
While browsing the Site, information related to the Client's device navigation (computer, tablet, smartphone, etc.) may be recorded through files called "cookies". The cookie allows tracking of navigation or analysis of the Client's behavior.
When connecting to the Site, the Client is informed by the appearance of a banner that cookies may be automatically installed on their browsing software during visits to the Site, as well as their purposes, the possibility to accept or refuse them, and to modify the settings by clicking on the "Manage your preferences" link. The Client can also modify their preferences through the browsing software used:

Several categories of cookies exist on the Site, including:
- Strictly necessary cookies
These cookies are necessary for the proper functioning of the Site and must remain active if the Client wishes to access all the services provided by the Site. They do not store any Data and result from actions taken by the Client, such as providing their privacy preferences or filling out a registration form.
The Client can always configure their browser to block these cookies or to be informed of their existence.
- Personalization cookies
These cookies allow the customization of the Site's features offered to Customers. They can be activated by ACE DENIM or by third parties whose services are used on the Site's pages.
- Advertising cookies
These cookies may be set by advertising partners within the Site, in order to offer content tailored to the Client's interests. They do not directly store Data, but are based on the unique identification of the browser and the Internet device.
- Analytical cookies
These cookies are used to measure the performance of the Site, particularly how the Client interacts with the Site by providing metrics on the number of visitors, the bounce rate, and the traffic source.
Article 10. CLIENT RIGHTS REGARDING THEIR PERSONAL DATA
In accordance with Articles 14 to 22 of the GDPR, the Client has the following rights, which they can exercise at any time:
- Right to information : the Client has the right to obtain clear, transparent, and understandable information about how ACE DENIM uses their Personal Data and about their rights. This information is provided in the Privacy Policy ;
- Right of access and rectification the Client can access their Personal Data and have it corrected if it is inaccurate, outdated, or incomplete;
- Right to erasure the Client can have their Data deleted, especially when it is no longer necessary with regard to the purposes for which it was collected;
- Right to restriction: the Client may request ACE DENIM to limit the Processing carried out from their Data ;
- Right to object : the Client may request at any time that ACE DENIM no longer process their Data and in particular no longer receive communications from ACE DENIM related to commercial offers and news ;
- Right to portability The Client may request the portability of their Personal Data in a structured, commonly used, and machine-readable format, to transfer it to another data controller, when the applicable conditions are met.
Also, in accordance with Article 85 of Law 78-17 of January 6, 1978, relating to data processing, files, and freedoms, the Client may set specific instructions regarding the retention, deletion, and communication of their Data after their death.

Any request to unsubscribe from the newsletter can be made to Customer Service at the email address contact@ace-denim.com.
To ensure that the Data is not subject to any unlawful use by third parties, we may request additional information from the Client to verify their identity.
In the event of a Data breach likely to result in a high risk to the rights and freedoms of Customers, ACE DENIM undertakes to notify the data breach to the competent data protection authority (the National Commission on Informatics and Liberty for France).
ACE DENIM will also inform Customers as soon as possible in accordance with the provisions of Article 34 of the GDPR.
Article 11. SECURITY AND CONFIDENTIALITY OF PERSONAL DATA
As the Data Controller, ACE DENIM is committed to protecting Customers' Personal Data using appropriate security and confidentiality measures, aimed at preventing any loss, alteration, destruction, or unauthorized use by a third party of the Personal Data.
Article 12. CLAIMS
For any questions regarding the Processing of Personal Data and the exercise of their rights, Customers can contact Customer Service at the email address contact@ace-denim.com.
In the event of a complaint regarding the protection of their Personal Data, Customers have the right to file a data protection complaint with the CNIL https://www.cnil.fr/.
Article 13. DIVERS
This Privacy Policy may be modified at any time according to changes in regulations and/or our practices regarding the Processing of Personal Data.
In case of changes, we will inform the Clients and the updated version of the Privacy Policy will be available on the Site in the "POLICIES" section.
The Privacy Policy may be modified to reflect changes in how we handle Customer Data. We will inform them as soon as possible of any significant changes. We will also publish an update to this Privacy Policy on the Site.
